Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and related services (the “Services”) offered by Traquify in connection with the domain traquify.com and related Traquify properties.

By accessing or using the Services, you agree to these Terms. If you are using the Services on behalf of a company or other entity, you represent that you have authority to bind that entity, and “you” includes that entity.

1. The Services

Traquify provides tools to help homeowners, contractors, and businesses collect and share information about property projects (for example room scans, reports, and communications related to quoting). Features may change over time. We may offer early access, beta, or preview functionality that is not final.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or enter into binding transactions through the Services. The Services are intended for use in the United States unless we expressly support other regions.

3. Accounts and security

You may need to register for an account. You agree to provide accurate information and keep it updated. You are responsible for safeguarding credentials and for activity under your account. Notify us promptly at legal@traquify.com if you suspect unauthorized access.

4. User content and license

You may submit content such as text, images, measurements, scan outputs, and messages (“User Content”). You retain ownership of your User Content. You grant Traquify a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify (for formatting or technical processing), display, and distribute User Content solely to operate, provide, improve, and secure the Services and as described in our Privacy Policy.

You represent that you have the rights needed to submit User Content and that it does not violate law or third-party rights.

5. Acceptable use

You agree not to misuse the Services. Without limitation, you will not: violate law; infringe intellectual property or privacy rights; harass, threaten, or harm others; upload malware or attempt unauthorized access; scrape or overload our systems without permission; use the Services to stalk, surveil, or record people without appropriate consent and legal authority; or misrepresent your identity or affiliation.

We may suspend or terminate access for conduct we reasonably believe violates these Terms or creates risk.

6. Third parties

The Services may integrate with or link to third-party services (for example maps, authentication, or payment providers). Those services are governed by their own terms and privacy policies. We are not responsible for third-party services.

7. Quotes, jobs, and professional work

Traquify is a technology platform. We are not a contractor, insurer, engineer, or home inspector. Information produced through the Services may be incomplete or inaccurate. You are responsible for verifying measurements, conditions, and regulatory requirements before relying on them for pricing, bidding, or performing work. Any contract for labor or materials is strictly between you and the other party.

8. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRAQUIFY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO TRAQUIFY FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), IF YOU HAVE NOT HAD ANY PAYMENT OBLIGATION TO TRAQUIFY.

Some jurisdictions do not allow certain limitations; in those cases, our liability will be limited to the fullest extent permitted by law.

10. Indemnity

You will defend, indemnify, and hold harmless Traquify and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the Services, or your violation of these Terms or applicable law.

11. Termination

You may stop using the Services at any time. We may suspend or terminate access to the Services or delete accounts if we reasonably believe you violated these Terms, create risk, or must do so to comply with law. Provisions that by their nature should survive will survive termination.

12. DMCA

If you believe material on the Services infringes your copyright, send a notice to legal@traquify.com with the information required under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512), including identification of the work, the material claimed to be infringing, your contact information, a statement of good faith, a statement of accuracy, and your physical or electronic signature.

13. Governing law and disputes

These Terms are governed by the laws of the United States, without regard to conflict-of-law rules that would require the application of another jurisdiction’s laws. Subject to applicable law, you and Traquify agree to bring disputes only in the state or federal courts located in the United States and consent to personal jurisdiction there.

14. Changes

We may modify these Terms from time to time. We will post the updated Terms on this page and update the “Effective date.” If a change is material, we may provide additional notice (for example by email or in-product message). Continued use after the effective date constitutes acceptance of the updated Terms.

15. General

These Terms constitute the entire agreement between you and Traquify regarding the Services and supersede prior agreements on the subject. If a provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
